Review tax abatement forms presented by Linn County Treasurer.

Authorize Chair to sign and submit a letter to the US Department of Energy pertaining to compliance with the Davis-Bacon Act in reference to a previously submitted Energy Efficiency and Conservation Block Grant (EECBG) Program grant application.

Presentation by Michael Richards on moving Freeway Lounge building.

Dawn Jindrich, Budget Director, Discuss and decide Fiscal Year 2011 Budget Calendar.

Presentation by the Auditor’s Office on Linn County mis-titled and excess real property.

Discuss & decide on approval of Family Farm Tax Credit for Linn County.

Discuss & decide on approval of Family Farm Tax Credit for the City of Cedar Rapids.

Discuss award/contract with Elert & Associates Technology Consultants to provide communications consulting services for a joint project involving the City of Cedar Rapids, City of Marion, several entities within Linn County Represented by the Linn County Sheriff’s Office.

Discuss reestablishing Linn County Radio Communications Committee.

LINN COUNTY BOARD OF SUPERVISORS
CEDAR RAPIDS, LINN COUNTY, IOWA
MONDAY, NOVEMBER 9, 2009 9:00 A.M.

The Board met in session at Linn County West. Present: Chairperson Barron, Vice Chairperson Langston, Supervisors Houser, Oleson & Rogers. Board members voting “AYE” unless otherwise noted

Auditor Miller stated that he is requesting the Board to consider addressing an Emergency Agenda Item with regard to the election in Prairieburg. He explained that he is requesting an administrative recount as there is a discrepancy in the number of write-in votes hand-tallied by the Precinct Election Officials and the number recorded by the voting machine.

Motion by Houser, seconded by Rogers to consider a request for an administrative recount for the city Prairieburg as an Emergency Agenda Item, noting that the request could not be given with a 24 hr. notice.

Motion by Houser, seconded by Rogers to grant an administrative recount in the city of Prairieburg.

Vickie Dippel, met with the Board to review tax abatement forms. She presented 50, some of them were given additional time to pay delinquent and were all submitted before the end of September.

The Board discussed the tax abatement form from Interstate Power Steam.
It was explained that the valuation was based on the percentage of time the plants were out of operation.

Supervisor Langston asked Dippel to check with Gary Jarvis one more time.

Motion by Langston, seconded by Houser to authorize the Chairperson to sign and submit a letter to the US Department of Energy pertaining to compliance with the Davis-Bacon Act in reference to a previously submitted Energy Efficiency and Conservation Block Grant (EECBG) Program grant application.

Michael Richards addressed the Board and stated that he will not be able to give a final proposal to move the Freeway Lounge noting that all utility companies need to be notified and there are several possible locations in the 3rd St./New Bo corridor.

Chairperson Barron asked Richards to meet with Darrin Gage regarding some concerns by Risk Management.

Dawn Jindrich, Budget Director, met with the Board to discuss and decide on the Fiscal Year 2011 Budget Calendar. Discussion continued regarding possible valuation growth and revenues and what impact that would have on the budget.

Steve Tucker, Financial Advisor, asked for clarification regarding the process and how the Board envisions the budget review to go.

The Board discussed the need for department heads and elected officials to attend their budget sessions with the Board and then the Board have two more opportunities to discuss and decide on each budget.

Jindrich will bring a sign up sheet to the next Elected Officials/Dept. Head meeting to sign up for budget sessions.

Tucker also asked the Board to consider some kind of a penalty for those budgets that are late.

Chairperson Barron stated that each board member should make sure they communicate with their liaison department heads to submit budgets on time.

Auditor Miller stated that his office took the initiative to take inventory of properties that Linn County owns as an outgrowth on conversations about tax abatements and looking for cost savings. The Conservation Board reviewed the list and came up with some recommendations regarding parcels that could be turned over to Cedar Rapids, Marion, etc. Miller asked that they have legal get involved and come back with some recommendations. Miller offered to be on a committee with legal, Conservation & Secondary Roads. The Board concurred.

Dave Ellis from the County Assessor’s Office and Beth Weeks of the City Assessor’s Office presented their Family Farm Tax Credits for Board approval.

Motion by Houser, seconded by Langston to approve Family Farm Tax Credits as submitted by the County Assessor.

Britt Hutchins, Purchasing Manager, presented results of bids received from consultants to provide communications consulting services for a joint project

between Linn County, Cedar Rapids and Marino. He explained that the low bid was received from Elert & Associates Technology in the amount of $83,500. Linn County will pay 30%. Discussion continued regarding where the funding would be coming from.

Sheriff Gardner stated that he was hoping that funding would come from outside his budget, however, it had to be paid from the Sheriff’s budget, it could.

The Board discussed an Ordinance stipulating public art in new Linn County buildings. Also present: John Shaffer, Kate Hawkins; Lijun Chadima, John Schwartzkobf, Deb Bailey, Jim Kern, and Bruce Williams.

The group discussed the establishment of a public art commission that would help select artists to design and build visual art in rebuilt county buildings. The Board will consider an ordinance that stipulates that perhaps 1% of the building cost be spent on public art projects. This is on the agenda tomorrow for a decision.

Garth Fagerbakke, Const. Serv. Manager, gave the following building update:

LCCS/Options – Weekly design meetings with committee and working on small internal programming issues; design team has a meeting weekly (Supervisors Langston and Houser attend); the landscape architect has meetings scheduled with Jon Gallagher and Randy Burke.
Juvenile Courts Bldg. – Weekly meetings on schematic design.
Admin. Office Bldg. – Novak Design Group is finishing up construction drawings; and working on grant information.
Sheriff’s Office – Putting in some finishes (flooring; doors; radio room 90% by 15th); and Tricon issued a Change Order in the form of a $69,000 credit (tuck pointing).
Correctional Center – STOP area is on schedule and need to start working on the additional boiler.

Auditor Miller reported that the results of the administrative recount of Prairieburg resulting in David Curl still being the winner. Three write-in’s did not have the oval marked.

The Board received and placed on file a letter from Iowa Realty Commercial stating that they have entered into a Purchase and Sale Agreement for the former Econofoods building.

The Board canvassed the November 3rd Municipal Election for the following cities: Alburnett, Bertram, Center Point, Central City, Coggon, Ely, Fairfax, Hiawatha, Lisbon, Marion, Mount Vernon, Palo, Prairieburg, Robins, Springville, Walker. Results are on file in the Auditor’s Office.

The Board received and placed on file the 2009 City Election Summary Report.

Auditor Miller advised the Board that while doing the post election audit, some tally books were left by an employee by the trash can and another employee who had a medical issue on the same evening apparently disposed of the tally envelopes. He stated that this does not affect the canvass or the results, however, they do not have any way of knowing the write-in’s for those precincts unless we have permission by the Board to recreate those tally books. Miller added that he is taking the appropriate action with the employees to make sure this doesn’t happen again.

Motion by Langston, seconded by Rogers to approve request by Auditor Miller to recreate tally books for November 3, 2009 election.

Supervisor Houser stated that the Auditor found all these parcels that Linn County owns and he appreciates his efforts. He noted that a previous employee’s duties (Jan Taylor) many years ago and she had problems back then getting rid of them. He wished the Auditor luck.
