This comment period is for the public to address topics on today’s agenda.

APPROVE MINUTES

Resolution approving Michael Radke, Republic Parking Systems, permission to use the Linn County owned lot near Diagonal Drive S.W. and “H” Street S.W. for the purpose of parking cars Tuesday, June 22, 2010 through Saturday, June 26, 2010.

Public Hearing and First Consideration to repeal and replace each of the following ordinances:
• Chapter 3, Linn County Building Regulations adopting the 2009 International Building and 2009 International Residential Code
• Chapter 4, Linn County Mechanical Regulations adopting the 2009 International Mechanical Code and 2009 International Fuel Gas Code
• Chapter 5, Linn County Plumbing Regulations adopting the 2009 Uniform Plumbing Code
• Chapter 32, Linn County Fire Regulations adopting the 2009 International Fire Code

Discuss the “Sharepoint User Memorandum of Understanding Between the Iowa Department of Public Health and the Linn County Board of Supervisors,” including designated Contract Administrators, Authorized Users and Viewers.

Discuss and authorize Chairperson to sign Agreement for Settlement by and between M.S. Govern, a division of N. Harris Computer Corporation (“M.S. Govern”) and Linn County, Iowa.

Authorize Chair to sign letter of support for Economic Development Group of Ely’s grant request to Iowa Network Services’ Charity Grant program for funding to help build the Ely Hoover Trail Waypoint.

LINN COUNTY BOARD OF SUPERVISORS
CEDAR RAPIDS, LINN COUNTY, IOWA
MONDAY, JUNE 21, 2010 9:00 A.M.

The Board met in session at Linn County West. Present: Chairperson Langston, Vice Chairperson Rogers, Supervisors Barron, Houser & Oleson. Board members voting “AYE” unless otherwise noted.

Public Comment:

Scott Smith, Cedar Rapids/Iowa City Building Trades, addressed the Project Labor Agreement for the Jean Oxley Public Service Center. He stated that the building trades agreed to allow a change in the ratio between the Options/LCCS PLA and the Juvenile Courthouse PLA. However, after several conversations with the building trade groups and doing some homework reviewing subcontractor lists submitted by the generals on those two projects, they have determined an insignificant change in non-union bidders. Therefore, they have decided that with this Jean Oxley Public Service Center project being the most keynote project on the list, the major affiliates support going back to the PLA language in the Options/LCCS building which requires a 1-1 ratio of referrals from union hall.

Mike Maccula, Plumbers and Pipefitters, addressed the proposed changes to the Mechanical Code. He stated that it will be confusing to the trade’s people if the county adopts a different fuel gas code.

Motion by Barron, seconded by Rogers to approve minutes of May 25, 2010 as printed.

Motion by Rogers, seconded by Houser to adopt Resolution 2011-6-114, approving Michael Radke, Republic Parking Systems, permission to use the Linn County owned lot near Diagonal Drive S.W. and “H” Street S.W. for the purpose of parking cars Tuesday, June 22, 2010 through Saturday, June 26, 2010.

A Public Hearing was called to order to repeal and replace each of the following ordinances:

Chapter 32, Linn County Fire Regulations adopting the 2009 International Fire Code.

Proof of publication was presented.

Brita Van Horne, Building Official, stated that each of the Appeal Boards met and reviewed proposed updates, noting that they do this every 3 years.
She addressed concerns of Maccula regarding the Mechanical code and Fuel Gas Code, noting that the Fuel Gas Code pairs well with the Mechanical code.
She stated that they can accept the International Fuel Code as an alternate.

There were no oral or written objections.

Motion by Houser, seconded by Rogers to close public hearing.

Motion by Rogers, seconded by Barron to approve upon first consideration Chapter 3, Linn County Building Regulations adopting the 2009 International Building and 2009 International Residential Code.

Motion by Barron, seconded by Rogers to approve upon first consideration Chapter 4, Linn County Mechanical Regulations adopting the 2009 International Mechanical Code and 2009 International Fuel Gas Code, noting that the International Fuel Gas Code will be accepted as an alternate.

Motion by Rogers, seconded by Houser to approve upon first consideration Chapter 5, Linn County Plumbing Regulations adopting the 2009 Uniform Plumbing Code.

Motion by Houser, seconded by Rogers to approve upon first consideration Chapter 32, Linn County Fire Regulations adopting the 2009 International Fire Code.

Ann Hearn, LCCS, met with the Board to discuss the “Sharepoint User Memorandum of Understanding between the Iowa Department of Public Health and the Linn County Board of Supervisors,” including designated Contract Administrators,

Authorized Users and Viewers. She will contact the Auditor’s office for the name of a viewer.

Jeff Clark, Asst. County Attorney and Phil Lowder, IT Dir., presented a document finalizing what was discussed in closed session regarding a settlement with M.S. Govern. Clark stated that they agreed to shake hands and part as friends.

Motion by Houser, seconded by Rogers to authorize Chairperson to sign Agreement for Settlement by and between M.S. Govern, a division of N. Harris Computer Corporation (“M.S. Govern”) and Linn County, Iowa.

Steve Tucker, Financial Dir., presented a document that is a part of the December 2009 $1,000,000 General Obligation taxable Election Depot Bonds (Paying Agent and Register Agreement). The Board will sign on Wednesday.

Motion by Rogers, seconded by Houser to authorize Chairperson to sign letter of support for Economic Development Group of Ely’s grant request to Iowa Network Services’ Charity Grant program for funding to help build the Ely Hoover Trail Waypoint.

Garth Fagerbakke, Construction Services Manager, stated that he will present for signature on Wednesday the IDNR storm water permit and $175 fee for Juvenile Courthouse storm water runoff management.

The Board reviewed building plans, finishes, LEED planning, site plans, landscaping and alternates (2) for the Linn County Jean Oxley Public Service Center. Also present: Gary Landhauser, Novak Design Group; Russ Allen, West Plains Eng. and Eric Shepley from Hall & Hall.

The two alternates include Terrazo flooring (rather than ceramic tile) and elevators (for competitive bidding purposes).

Discussion continued regarding the gathering of data for this building as it pertains to LEED (Silver) and the savings that they hope to achieve.

The Board will approve on Wednesday.

The Board discussed a Project Labor Agreement for the Linn County Jean Oxley Public Service Center.

Gary Jarvis stated that he has made one change to the resolution procedures
that specifically identifies parties at the first level to resolve any dispute.

Motion by Houser, seconded by Barron to go back to the original language for the Project Labor Agreement (1-1 ratio).

Discussion: Motion by Oleson, seconded by Rogers to propose amendment to the motion to include an exception to include language in the Juvenile Courthouse PLA, if 6 or less, use your own crews.

Discussion: Supervisors Houser stated that he has got 20 years experience and no one will have 6 of any craft on the job at one time. He stated that this is an unfair disadvantage to the unions and the main emphasis of a PLA is to put people to work at a fair and competitive wage.

Chairperson Langston asked if there was a variety of people on the subcontractor list who bid on the Juvenile Courthouse and Fagerbakke responded that he does not necessarily see all of the subcontractors.

Supervisor Oleson asked Scott Smith how he knew there was an insignificant change in non-union bidders if we don’t have a list of all subcontractors who showed interest as stated by Fagerbakke.

Smith stated that he obtained a copy of all general’s subcontractors from Fagerbakke and compared it to the list from different crafts.

Supervisor Oleson continued to say that for the last 20 years there has been no PLA’s and the people involved on this Board for the last 20 years have not lifted a finger for one of these agreements. Now they have done two and most people know how that has come to be. Oleson stated that if 6 and under is not that significant, then it won’t hurt. He stated that he has a number of people in his community that tell him when something is working or not. Oleson stated that he has been contacted by non-union companies that have hard working people that try to keep food on their table such as Culver’s Landscaping; Colony Heating & Cooling and Rathje Construction. He also stated that he didn’t know there was anything wrong with the last PLA from the trades, noting

that Ray Dochterman and Dave Hogan do not oppose it. Oleson continued to say that Scott Smith had no opposition over the exception in the Juvenile Courthouse PLA which totally shocked him to find out his thoughts today. He was told by Fagerbakke that there is no information that can tell us the difference in participation. This is more to do with election year politics and partisan politics which should not be involved at all. Oleson stated that what is right for this community is to get as many as they can to bid and he doesn’t care if they are union or non-union. They are required to pay prevailing wage either way.

Supervisor Houser stated that Linn County has had a mini Davis Bacon Act for years and they haven’t had any projects since they were told they can’t use it.
With regard to landscaping, it is not affected by the project ratio.
He continued to say that when Supervisor Oleson asked him about a PLA, he said a one time project. It is an unfair disadvantage to the union. He will vote against an amendment and will stay with a 1-1 that was tested through the Supreme Court.

Supervisor Oleson clarified that Culver’s landscaping is looking at the paving portion of the bid.

Supervisor Houser stated that Oleson’s amendment is a ploy for union busting.

Supervisor Barron stated that she thought the first big project (Options/LCCS Bldg.) was appropriate for the 1 to 1 ratio and then a change for the smaller project (Juvenile Courthouse) was ok. In her opinion, the Jean Oxley Public Service Center is a larger project; especially with the remodeling part of it, and would be a better fit for a 1 to 1 ratio.


Supervisor Rogers stated that he is glad they are doing a third PLA. He stated that it is unfortunate that it has taken certain turns, but at the end of the day, local people will be working on local jobs.

VOTE ON THE AMENDMENT – PLA that would mirror the Juvenile Courthouse Agreement.

VOTE ON ORIGINAL MOTION – PLA (1 to 1 ratio) Same as LCCS/Options Bldg.

PUBLIC COMMENT:

Dave Hogan stated that the Board is doing great work for Cedar Rapids and Linn County.

The Board received and placed on file the following correspondence:

Letter from Olivet Neighborhood Mission regarding Youth Shelter.

Notice of Voluntary Settlement for Aegon assessment.

The 10:30 a.m. meeting with the federal lobbying firm, Williams and Jensen has been cancelled.
